The Effectiveness of Court-Connected Dispute Resolution in Civil Cases

This article summarizes more than 40 studies of small claims, appellate, and general civil cases. The summaries include information on program structure, process, and outcomes of the programs studied. The author notes that on the whole, empirical research indicates that mediation and early neutral evaluation settle cases and that participants perceive the process and outcomes to be fair. On other factors, the findings are more ambiguous. Also unclear is the impact of program structure on outcomes.
